Public Offer for the Provision of Educational Services
Post Punk Publishing LLP (hereinafter referred to as the "Provider") offers any individual (hereinafter referred to as the "User") to enter into this agreement (hereinafter referred to as the "Agreement") for the provision of paid educational services (courses) on the terms set forth below. Full and unconditional acceptance of this Agreement is the User's payment for the selected Course.
1.1. Provider — Post Punk Publishing LLP, registered at Stoney Works, 8 Stoney Lane, London, United Kingdom, SE19 3BD.
1.2. Agreement — this public offer, published by the Provider on the Service.
1.3. Service — the website baza.education and its subdomains, together with associated pages, Telegram channels and chats of the Provider.
1.4. Course — an educational program (a set of Materials and, where provided for, consultations, webinars and assignments) selected and paid for by the User.
1.5. Services — the provision to the User of access to the Course and related educational Materials.
1.6. User — an individual who has accepted this Agreement.
1.7. Acceptance — full and unconditional acceptance of this Agreement by paying for the selected Course.
1.8. Materials — text, graphic, audio and video materials provided to the User as part of the Course.
1.9. Personal Data — information relating to the User: name, email address, and other data provided during registration.
2.1. The Provider undertakes to provide the User with access to the selected Course and related Materials, and the User undertakes to pay for the Services in accordance with the terms of this Agreement.
2.2. The Services are deemed to have been duly provided from the moment the User is granted access to the Course Materials.
2.3. The scope, format and duration of each Course are described in the corresponding presentation and/or on the Service.
3.1. To access the Services, the User shall: register by providing accurate information; review the terms of this Agreement; select a Course and pay for it.
3.2. The Agreement is deemed concluded at the moment the funds are credited to the Provider's account.
3.3. Access to the Course Materials is granted after payment is confirmed, within the timeframe specified for the relevant Course.
4.1. The cost of the Services depends on the Course selected by the User and is specified in the presentation, commercial offer and/or on the Service at the time of payment. This Agreement does not fix the price of the Services.
4.2. Payment is made using the methods available on the Service. The date of payment is the date on which the funds are credited to the Provider's account.
4.3. Specific prices, discounts, instalment options and payment terms are set out in the presentation and/or on the Service for the relevant Course and may differ between Courses and promotional offers.
4.4. Unless otherwise stated for a particular Course, the Services are paid for in full before access is provided.
The Provider undertakes to:
5.1. Grant the User access to the Course Materials within the timeframe specified for the relevant Course after payment confirmation.
5.2. Ensure proper quality of the Services.
5.3. Notify the User of any changes to the terms of this Agreement by publishing them on the Service.
The Provider reserves the right to:
5.4. Modify the content, format and schedule of the Course without reducing its overall scope.
5.5. Suspend or terminate the User's access to the Services in the event of a breach of this Agreement.
5.6. Engage third parties to provide the Services.
The User undertakes to:
5.7. Provide accurate information during registration.
5.8. Pay for the Services in a timely manner.
5.9. Not distribute, copy or share the Materials with third parties without the Provider's written consent.
The User has the right to:
5.10. Receive the Services in the scope corresponding to the Course paid for.
6.1. The User consents to the processing of personal data in accordance with applicable data protection laws, including the UK Data Protection Act 2018 and the UK GDPR.
6.2. The Provider processes the User's personal data solely for the purpose of fulfilling this Agreement.
6.3. The Provider takes necessary measures to protect personal data from unauthorized access.
7.1. This Agreement takes effect upon Acceptance and remains in force until the parties' obligations are fulfilled.
7.2. The User may refuse the Services by sending a notice to baza@baza.education. Amounts paid for Services already provided, including access already granted to Course Materials, are non-refundable.
7.3. The Provider may terminate this Agreement unilaterally if the User breaches its terms, including sharing Materials with third parties.
7.4. Refund requests are reviewed upon application to baza@baza.education within 10 (ten) business days, taking into account the volume of Services already provided.
8.1. Neither party shall be liable for failure to perform its obligations due to force majeure circumstances.
8.2. The Provider shall not be liable for temporary interruptions in the Service caused by technical issues.
8.3. The Materials are of an informational nature. The Provider does not guarantee any specific income, employment or other outcome, as such results depend on the User's own actions.
8.4. The User is responsible for maintaining the security of their account credentials and for all activities conducted through their account.
9.1. All Materials are the intellectual property of the Provider and are protected by applicable law.
9.2. The User undertakes not to distribute, copy, reproduce or create derivative works from the Materials, in whole or in part, without the Provider's written consent.
10.1. Any disputes shall be resolved through negotiation. If a dispute cannot be resolved amicably, it shall be submitted to the courts of England and Wales.
10.2. Claims from the User shall be reviewed by the Provider within 10 (ten) business days of receipt.
10.3. The Provider reserves the right to amend this Agreement. Changes take effect upon publication on the Service.
10.4. In all matters not covered by this Agreement, the parties shall be governed by the laws of England and Wales.
